1. Organization of trading on the LastMile platform. Buyer and seller

1.1 LastMile organizes, performs, and provides related services to the Buyer UAB "Greituolis", legal entity code 305054987, VAT number LT100012351618, registered office at Kalno str. 26, Aukštieji Rusokai, LT-14180 Vilniaus r., Food business operator identification number 410002223 (referred to in these Rules as LastMile). 1.2. Only products sold in LastMile Shop, LastMile IKI, Vyno guru, and Bembel accounts are sold to the Buyer by LastMile (In LastMile IKI account, LastMile sells products to UAB PALINK, from which physical outlets have been chosen and ordered by the buyer, name, and interest). In all other accounts of the LastMile platform (except for LastMile Shop, LastMile IKI, Vyno guru, and Bembel), the seller of the goods is the operator selling them - the store from which the physical outlets were chosen and ordered by the Buyer (hereinafter these entities and LastMile are collectively referred to as the "Seller"). 1.3. Any person who purchases on LastMile or uses other services of the LastMile platform (such person is referred to as the Buyer in these Terms and Conditions) shall be considered as a buyer. Adult persons whose capacity is not restricted shall have the right to use and purchase the LastMile platform. 1.4. LastMile has the right but does not undertake, to allow legal entities acting through authorized representatives to register and hold the Buyer. However, the LastMile platform is primarily an online retail shop for consumers, i.e., natural persons purchasing products for their own personal, family, and household needs. LastMile Store is not specifically designed for individuals intending to sell or purchase products for business or professional needs. 1.5. LastMile reserves the right not to accept orders, not to fulfill orders or cancel them, to cancel registrations if the Buyer orders unusually large quantities of products (regardless of whether the products are ordered in a single order or several orders placed in a relatively short period) and LastMile has reason to believe that the Buyer's activities have the characteristics of wholesale purchase. 1.6. In all cases, only persons under the age of 18 have the right to order and collect energy drinks. In all cases, only sober persons under the age of 20 have the right to order and collect alcoholic beverages. 1.7. If the Buyer completes the registration on LastMile, he/she shall in all cases provide an unconditional confirmation that he/she meets the requirements of these Terms and Conditions for The Buyer who wishes to lawfully use the LastMile platform. 1.8. The Buyer and the Seller communicate (including the submission of any requests, notifications, claims) using the functionality of the mobile application or by e-mail – by sending correspondence to the Buyer at the e-mail address provided in its registration form, by sending correspondence to the Seller by e-mail(info@lastmile.lt).

2. Status and application of the rules

2.1. These rules for purchase on the online platform LastMile (referred to in this document as the Rules) determine the procedure for using the mobile application and the online store www.lastmile.lt (both jointly and/or separately referred to in the Rules as LastMile). 2.2. These Rules apply when the buyer chooses, orders, purchases, picks up, returns products offered on LastMile's online platform, as well as using any LastMile services. 2.3. These Rules together are a distance purchase and sale agreement between the Buyer and the Seller. The Rules are established and must be interpreted following the law of the Republic of Lithuania by the relations to which they apply. 2.4. In the case of the purchase and sale of alcoholic beverages, the separate provisions of these Rules shall apply to the relationship between the Buyer and the Seller. 2.5. Buyer has no right to place orders on LastMile if he/she is not familiar with the Terms and/or disagrees with them or their provisions. If the Buyer orders products through the LastMile platform, in all cases it is considered that the Buyer has fully familiarized himself/herself fully and unconditionally agreed to all provisions of the Rules and assumes any risk due to possible incomplete familiarization with the Rules. 2.6. LastMile has the right to change the Terms at the time or manner of its choice. The relationship between the Buyer and the Seller shall be subject to the version of the Rules which was in force at the time of placing the order. 2.7. LastMile has the right to restrict buyer's use of LastMile platform services without notice and/or cancel buyer registration if the Buyer violates the Rules by registering or withdrawing products containing non-reality information, engaging in illegal activities, attempting to undermine the operation, reputation, security of the LastMile platform, its stores or data, as well as in other cases where LastMile deems it necessary to ensure the proper functioning of the LastMile platform or business practices require it. 2.8. These Rules are established following the legal acts of the Republic of Lithuania. 2.9. Relations arising based on these Rules shall be governed by the law of the Republic of Lithuania.

3. Conclusion of the contract

3.1. The purchase and sale agreement defined in these Rules shall be deemed concluded when the Buyer completes the registration, forms, and places an order on LastMile platform, makes payment following the procedure and time limits established in the Rules and receives LastMile confirmation in the mobile application or by e-mail specified by the Buyer (if the products are purchased in the online store) that the Buyer's order has been accepted. 3.2. When, according to the legal acts of the Republic of Lithuania, the purchase of a particular product is permitted only to persons who meet certain additional requirements (who have reached a certain age limit, are sober, etc.), the contract for the purchase and sale of such product between the Buyer and the Seller shall be deemed concluded when the LastMile courier checks and determines at the time of delivery of the products that the Buyer and/or other products at the Buyer's address are entitled to purchase the ordered products and transfer them to the Buyer. 3.3. When, using LastMile's functionalities, alcoholic beverages ordered from the Seller (which are purchased (ordered, withdrawn) are entitled only to persons who are at least 20 years of age, who are not intoxicated from alcohol), the Agreement on the Purchase and Sale of Alcoholic Beverages between the Buyer and the Seller, the address of the licensed point of sale, which has the right to carry out the retail sale of alcoholic beverages, shall be deemed concluded from the moment when the LastMile courier providing the delivery service checks and determines at the time of delivery of the products that the Buyer and/or the person withdrawing other products at the Buyer's address has the right to purchase or withdraw such ordered products (among other things, checks the personal document of the Buyer (or another person of the age withdrawing the products at the Buyer's address), assesses sobriety, the date and time of delivery of alcohol, etc.) and transmits them to the Buyer. 3.4. If the Courier determines that the Buyer or other persons withdrawing the products at the Buyer's address do not have the right to purchase ordered alcoholic beverages or other specially regulated products, the contract for alcoholic beverages or such other products shall be deemed not to have been concluded, these products shall not be transferred to the Buyer (or another person seeking to collect the products at the Buyer's address) and their price nor the price of their delivery shall not be refunded to the Buyer – such price shall be considered a fine to compensate for minimal losses for violations of the agreement outlined in the Rules. If in such a case LastMile provides only the courier (delivery) service, LastMile also has the right not to refund the delivery fee to the Buyer and/or to demand payment for the return of the products (the return price is in any case not lower than the delivery price).

4. Registration and login details

4.1. To purchase products offered on LastMile, the person must register with LastMile by filling in the registration form: your name, surname, e-mail, address where the products will be delivered, telephone number, other data necessary for the delivery of products. The authorized representative of the legal entity must also indicate the name of the legal entity. 4.2. The Buyer is fully responsible for the completeness and compliance of the registration data with reality. 4.3. If the registration data changes, the Buyer must update them. Otherwise, the Buyer assumes all the risk due to the discrepancy of the data and the resulting losses of the Buyer, the Seller, and/or third parties. 4.4. When making the registration, the Buyer creates a username and password under his responsibility and must not disclose them to any third parties. The Buyer must immediately inform LastMile about the loss or disclosure of login data to unauthorized third parties. The Buyer assumes all risks due to the use of the Buyer's login data by third parties and the resulting losses of the Buyer, LastMile, the Seller, and/or third parties. In no case shall the Seller be liable for damage caused to the Buyer, the Seller, third parties by logging in to the LastMile store using the Buyer's login data. 4.5. It is recommended that you change a password that consists of at least 8 characters (uppercase and lowercase letters, digits, dots, other punctuation marks, and change the password every 6 (six) months.

5. Product prices

5.1. The prices of the products that can be ordered on LastMile (thus the prices of the products in the order form by the Buyer) are indicated in Euros including VAT. 5.2. The products are sold to the Buyer at the prices indicated on the LastMile platform at the time of placing the order. The prices of the products may differ from those charged at the respective physical outlets operated by third parties; in any event, only the prices of products published on LastMile are used to purchase on LastMile. 5.3. If the product ordered is accompanied by an indication of the discount applied to it and the period of validity of the discount, the indicated lower price for the product shall apply if the chosen delivery date for that product is before the expiry of the specified discount. If the delivery date of the product is later than the stated expiry date of the promotion, the product shall be subject to the regular price of the product. The Buyer is informed about such changes in the price of the product until the moment of placing the order. 5.4. LastMile has the right to set a minimum amount for which the Buyer must order products on LastMile if he wishes to place an order (and, accordingly, conclude a purchase and sale agreement and receive a delivery service). 5.5. For weighing goods, the LastMile platform additionally reserves funds, which account for up to 20% of the number of goods weighed. After the execution of the order, after assessing the weight of the goods delivered, the balance of unused funds shall be returned following the procedure established in Paragraph 5.6 of the Rules. 5.6. The difference between the price of the product paid by the Buyer and the actual price of the product shall be refunded to the Buyer within 5 working days by transferring this amount of money to the bank account from which the payment was made when placing the order.

6. Delivery price

6.1. On the LastMile platform, the prices of delivery services (thus the delivery price in the order form by the Buyer) are indicated in Euros including VAT. 6.2. A fee is paid for the product delivery service, calculated, and applied at the moment of placing the Buyer's order. This fee may be specified fixed or changed depending on the value of the products ordered by the Buyer and/or the delivery deadline. The Buyer in any case follows the delivery price indicated at the time of placing his order. 6.3. If the LastMile system allows the Buyer to replenish the shopping cart after order confirmation, the delivery service fee does not change.

7. Settlement procedure

7.1. The Buyer pays for the Products at the time of ordering by making a prepayment. 7.2. The Buyer can pay for the purchased products using his/her payment card – MasterCard, VISA, or VISA Electron debit or credit card if such card is issued in a country of the European Economic Area; Payment cards issued in other countries may not be serviced on LastMile. 7.3. When paying for purchases by the Buyer's credit or debit card for the first time, the Buyer will have to enter the data required by the system for his/her card. In case of subsequent payments for purchases by credit or debit card, sometimes, if the Buyer has already paid once on LastMile, the LastMile platform system will offer to pay with the same credit or debit card that the Buyer had previously made at least once and will not require re-entering the card details. In this case, if the Buyer agrees to complete the purchase by paying by the same Buyer's credit or debit card, which the Buyer had previously paid for purchases in LastMile store, it will be sufficient for the Buyer to re-enter the password of the Buyer's login to the LastMile store system. 7.4. The Buyer may at any time, by logging in to the LastMile store system, delete the details/list of payment cards that were previously used to make payments on LastMile. 7.5. Neither by specifying credit or debit card details in LastMile nor by paying by credit or debit card, the Buyer does not leave the card data in the LastMile store system, as the Buyer is redirected to a secure server of a certified service provider for the execution of the payment transaction. Only partial information about the payment card number is returned to the LastMile store system from this server. 7.6. After receiving confirmation from the selected payment system operator in LastMile about the buyer's proper payment for purchases and their delivery, the order starts to be executed and the delivery deadline begins to run. 7.7. If the Buyer wishes to receive a VAT invoice, the Seller shall issue it and provide the Buyer with the e-mail indicated in the Buyer's registration form within 3 working days after the delivery of the products. The Buyer does not provide VAT invoicing or transmission services when the Buyer buys products from third parties.

8. Product picking

8.1. After the Buyer places an order using the functionality of the LastMile platform, LastMile couriers go to the physical outlets of third parties and collect the products ordered by the Buyer. 8.2. LastMile couriers are employed by persons who have passed the courses regulated by the State Food and Veterinary Office and received their certificate of completion, as well as after hearing LastMile's briefing on the collection and transportation of goods. 8.3. LastMile makes sure that the courier has the right equipment for the transportation of food products, so each courier is issued with a temperature-maintaining and nature-protected bag for the transportation of food items. 8.4. Information about the characteristics of the products, product descriptions, information about the non/presence of the relevant product in the store is provided by the third party managing the physical outlets from which the products ordered by the Buyer are ordered and collected. LastMile makes every effort to ensure that this information is accurate, true, and timely, but cannot guarantee its full accuracy at any time, and assumes no responsibility for the actions of a third party. 8.5. LastMile and LastMile couriers will always make every effort to ensure the highest quality of service and fulfill the Buyer's order as accurately as possible. However, LastMile cannot guarantee that all orders can be properly and fully fulfilled at any time – due to the absence of products at points of sale, their weight discrepancy, other reasons due to third parties or external circumstances, LastMile couriers may not be able to accurately fulfill (part of) the order. The Buyer is aware of this and is not considered a breach of LastMile's obligations. 8.6. In cases where the relevant physical retail outlet operated by a third party, where the LastMile courier collects the products ordered by the Buyer, does not contain a particular product ordered by the Buyer or has a quantity smaller than the one ordered by the Buyer, LastMile has the right not to deliver this product, to deliver a smaller quantity of the product or to offer the Buyer a similar product (for example, a product of another manufacturer with the same or similar characteristics or another product that could, due to the same or similar characteristics, replace the ordered product). If such delivery of a similar product is not acceptable to the Buyer, LastMile can indicate in the store system that he does not agree with it. If the price of a similar product is higher than that of the ordered product, additional funds are reserved in the buyer's account, the unused part of which after shopping is returned to the Buyer's account. If the price of the like product is lower than that of the ordered product, the price difference shall be refunded to the Buyer following the procedure established in Clause 5.6 of the Rules. 8.7. In cases where the LastMile courier must deliver the weighed product ordered by the Buyer from the respective physical retail outlet operated by a third party, the price of the product weighed in the Buyer's order shall be calculated provisionally following the procedure established in Clause 5.6 of the Rules. Due to the specificity of the product and/or other circumstances that the LastMile courier cannot influence, the actual weight of the product delivered may differ from the weight of the product ordered and tentatively paid by the Buyer. If the weight of the delivered product is less than the ordered weight of the product, the price difference due to the difference in weight shall be returned to the Buyer following the procedure established in Clause 5.6 of the Rules.

9. Product delivery. Transmission and acceptance

9.1. After the Buyer places an order using the functionality of the LastMile store, the products are delivered to the address indicated by the Buyer by the collected LastMile couriers. 9.2. The term of delivery of products starts to run from the Buyer's proper payment for the products and their delivery. 9.3. You can check the locations to which LastMile couriers can deliver products in the information published in the LastMile store. They may be set and modified by LastMile at its sole discretion. 9.4. The Buyer (or other person accepting the delivered products) must check the products delivered by the LastMile courier before accepting them and does not approve the proper delivery, transfer, and acceptance of the shipment if it finds any discrepancies in quantity, quality, assortment or other discrepancies, violations of the products or packages. After confirming the proper transfer and acceptance of the products, the Buyer subsequently has no right to make claims regarding the above inconsistencies/violations. 9.5. The delivery of a similar product or quantity of another product (as discussed in paragraphs 8.5 – 8.7 of the Rules) is not considered a discrepancy in quantity, quality, assortment, and after their transfer and acceptance at the time of delivery, LastMile is considered to have properly fulfilled the order. 9.6. If the Buyer detects discrepancies in quantity, quality, assortment or other discrepancies, violations of products or packages during the inspection of the delivered shipment, the Buyer shall inform the LastMile courier who delivered the products, who shall mark the discrepancies in the system he administers. 9.7. Products of inadequate quality, products that have not been ordered or whose quantity is delivered more than the ordered quantity are returned to the LastMile courier. 9.8. If the products ordered by him are not delivered to the Buyer, or if the quality of the ordered products is inadequate, the price of such paid products shall be refunded to the Buyer within 5 working days by transferring this amount of money to the bank account from which the payment was made when placing the order. 9.9. LastMile courier delivers the ordered products to the Buyer by placing the order at the selected delivery time (within the selected time frame). 9.10. If the Buyer orders alcoholic beverages, all products included in such an order (not only alcoholic beverages) are delivered no earlier than 10:00 and no later than 20:00, and on Sundays – no earlier than 10:00 and no later than 15:00. On 1 September, alcoholic beverages are not sold, and orders containing alcoholic beverages are not executed. 9.11. LastMile and LastMile couriers will always make every effort to ensure the delivery of the order at the time chosen by the Buyer or if the Buyer chooses delivery immediately – within the shortest objectively possible time. However, LastMile cannot guarantee that all products will always be delivered on time without any obstacles. Therefore, LastMile accepts no responsibility for the delay in delivery if the delay is not due to LastMile's circumstances under LastMile. In case of delay in delivery, LastMile will contact the Buyer to agree on a mutually acceptable solution to the situation. 9.12. The Buyer undertakes to accept the products delivered by the LastMile courier himself at the address indicated by the Buyer in the LastMile store system at the delivery address and at the time that the Buyer has chosen to accept the order. LastMile shall not be liable for the proper performance of its contractual obligations if the Buyer provides the wrong address, or the Buyer is not found at the address indicated by him at the time of delivery. 9.13. LastMile courier, having not found the Buyer at the address indicated by the Buyer at the time of delivery, has the right to transfer the delivered products to another adult person at the delivery address indicated by the Buyer, and this will be considered a proper fulfillment of LastMile's contractual obligations, and confirmation of the transfer and acceptance of products by such other person will be considered as a proper confirmation of the transfer and acceptance by the Buyer. The delivery of alcoholic beverages, energy drinks, and some other products may be subject to additional conditions. 9.14. If the LastMile courier does not find the Buyer at the delivery time chosen by the Buyer and no other person is meeting the requirements of these Rules and/or legal acts to whom LastMile courier could transfer the delivered products, LastMile is considered to have properly fulfilled the contractual obligations, and the Buyer must agree with LastMile customer service for the quality of the goods not picked up on time. 9.15. In the cases referred to in point 9.14, LastMile may store the products until 22:00 on the date of delivery, to inform the Buyer about the address of their place of storage and to enable the Buyer to withdraw such products at an agreed time and its own expense. In this case, LastMile undertakes no obligation to ensure any special conditions of storage of the products, including, but not limited to, the storage of a special environment that meets hygiene standards or other special requirements, and assumes no responsibility for the quality of such products not properly and timely accepted at the order address (including but not limited to the characteristics of their use, appearance, preservation, survival in usable, safe, etc.).

10. Rules applicable to the ordering and delivery of energy drinks and alcoholic beverages

10.1. Energy drinks, as defined in the Law on Food of the Republic of Lithuania, can be ordered by the Buyer only if he is at least 18 (eighteen) years old and he confirms this in the manner established in the LastMile store system. Energy drinks shall be transferred to the Buyer (or another adult product-accepting person at his address) only if the Buyer (or another person accepting products at his address) is at least 18 (eighteen) years of age and when withdrawing the products, he submits a valid identity document (passport of a citizen of the Republic of Lithuania (or a foreign state), an identity card of a citizen of the Republic of Lithuania (or a foreign state) or a new model (issued after 1 November 2005) confirming this to the Seller's representative driving license of the Republic of Lithuania). If the Buyer (or another adult product-accepting person at his address) fails to provide a personal document, upon presentation of an invalid identity document or if it becomes clear that the Buyer (or another person accepting the products at his address) is under the age of 18 (eighteen), the Seller's representative does not transfer the energy drinks to the Buyer (or another adult host person at his address) and it is considered that the delivery of the products (energy drinks) is impossible due to the fault of the Buyer or due to circumstances dependent on the Buyer, and therefore the contract for the purchase and sale of energy drinks is considered not to have been concluded. 10.2. Alcoholic beverages, as defined in the Law on Alcohol Control of the Republic of Lithuania, can be ordered by the Buyer (natural person) only if he is at least 20 (twenty) years old, he is sober and confirms this in the manner established in the LastMile store system. 10.3. Legal persons may order and purchase alcoholic beverages only for representative purposes and for other purposes permitted by law. The Buyer's legal entity when ordering alcoholic beverages in LastMile store confirms that he acquires alcoholic beverages for representative purposes or other purposes permitted by law and there are no restrictions established in Article 17(6) and (7) of the Republic of Lithuania Law on Alcohol Control for the Buyer to purchase alcoholic beverages. 10.4. Delivery of alcoholic beverages LastMile is possible only at the time specified in clause 9.10 of the Rules. 10.5. Before handing over alcoholic beverages to the Buyer (or another person who has reached the age of 20) the LastMile courier first assesses the sobriety of the Buyer (or another person who has reached the age of 20 at his address) (i.e., whether there are any indications that it is possible to suspect that the person accepting alcoholic beverages is drunk and/or intoxicated). In case of suspicion of drunkenness of the Buyer, alcoholic beverages are not transferred. In such a case, it is considered that the delivery of alcoholic beverages is impossible due to the fault of the Buyer or due to circumstances dependent on the Buyer, and the contract for the purchase and sale of alcoholic beverages shall be deemed not to have been concluded. 10.6. Alcoholic beverages are transferred to the Buyer (or another person who has reached the age of 20) only if there are no suspicions about the Buyer (or another 20-year-old at his address). at least 20 (twenty) years of age and when withdrawing the products, the Buyer (or another person who has reached the age of 20 at his address) shall present a valid identity document (passport of a citizen of the Republic of Lithuania (or a foreign country), an identity card of a citizen of the Republic of Lithuania (or a foreign country) or a new model (issued after 1 November 2005) when withdrawing the products driving license of the Republic of Lithuania). If the Buyer (or another person accepting products who has reached the age of 20 at his address) fails to provide a personal document, submits an invalid identity document, or becomes clear, that the Buyer (or another person accepting the products at his address) is under 20 (twenty) years of age, LastMile courier does not transfer alcoholic beverages to the Buyer (or another person who has reached the age of 20) at his address and it is considered that the delivery of products (alcoholic beverages) is impossible due to the fault of the Buyer or due to circumstances dependent on the Buyer, therefore the contract for the purchase and sale of alcoholic beverages is considered not concluded.

11. Information on products, their quality, shelf-life

11.1. The Seller is responsible for the sale of the products ordered in the LastMile online store to the Buyer, their proper delivery, proper fulfillment of the conditions of return, and implementation of other rights and obligations of the seller-provided for in legal acts. 11.2. The features of the products offered for purchase on the LastMile platform are presented in the in-store product descriptions published by LastMile but are prepared and provided by third parties who manage the physical retail outlets where the products are sold. The legal entities managing the descriptions they draw up and the quality of the products sold, including information on the characteristics of the products (correctness, accuracy, completeness, proper presentation, compliance with other legal requirements) shall be the responsibility to the maximum extent permitted by the legislation of the natural retail outlets from which LastMile couriers collect and purchase LastMile products, as well as manufacturers and/or importers of such products. The Seller provides a platform for publishing the above information, is responsible for the proper collection and purchase of products, accounting of orders formulated, fulfillment/delivery of orders. 11.3. LastMile shall not be liable if the products displayed on the LastMile platform on the Internet differ in color, shape, or other parameters from the actual products delivered due to discrepancies in the information transmission process – for example, the characteristics of the display (monitor) used by the Buyer or other technical reasons, as well as taking into account reasonably possible inconsistencies in appearance. 11.4. If the Seller does not specify a special term of quality guarantee for the product, such product is covered by the warranty provided for in the applicable legislation. 11.5. If the applicable legislation determines the shelf-life of certain products, the Seller sells/delivers such products to the Buyer in such a way that the Buyer has a real opportunity to use such products before the expiry date.

12. Buyer's right to return products

12.1. The Buyer has the right to return the products (to withdraw from the purchase and sale agreement concluded on the LastMile platform) if more than 14 calendar days have not passed since the date of delivery of the product to be returned, and if the restrictions on return/withdrawal provided for in clauses 12.2 – 12.5 of the Rules or legal acts are not applied. 12.2. Return of quality products (to withdraw from the purchase and sale agreement concluded on the LastMile platform) is not entitled buyers who cannot be considered consumers under the applicable consumer rights legislation, i.e., legal persons and natural persons purchasing products for business, commercial, professional needs (purchasing products for non-personal/family use, not for domestic use). 12.3. The Buyer shall not be entitled to return quality products if such products fall within the exceptions defined by law (if under the applicable legislation, the seller is not obliged to accept such returned products, or if distance contracts concluded for the purchase of such products cannot be terminated by buyers without a reason following the procedure specified in the Rules). For example, LastMile is not required to accept returns of quality: 12.3.1. perishable products, as well as products with a short shelf-life; 12.3.2. products which have been sold packaged but have been unpacked after delivery and are unsuitable for return for health or hygiene reasons (e.g., most cosmetics, etc.); 12.3.3. video or audio recordings than software, if it was sold packaged but unpacked after delivery; 12.3.4. periodicals: newspapers, periodicals, magazines. 12.4. The Buyer has no right to return quality products if they have been used after delivery, are damaged, have lost their commercial appearance (including if labels have been removed and/or damaged, protective films are torn off, etc.) after losing their consumer properties. To return the product, the Buyer must ensure that it is returned in its original packaging, in the same set as it was delivered, with all documents and belongings provided at the time of delivery. 12.5. The Buyer has no right to return quality products if the repayment terms established in the Rules and/or legal acts are omitted. 12.6. If the Buyer wants to return the products due to inadequate quality: 12.6.1. defective perishable goods (food and beverages with a short shelf life for which the manufacturer has established a special temperature regime) – the Buyer must provide the Seller with a notice of return following the procedure established in the Rules no later than within 72 hours from the moment of delivery of such product of inadequate quality; 12.6.2. defective non-perishable goods – it is possible to return them following the terms and procedure established by law (if the manufacturer or third party whose physical retail outlet LastMile courier has collected the products does not provide for a mode more favorable to the consumer than provided for by law). 12.7. To return the delivered product, the Buyer submits a return request by e-mail info@lastmile.lt, indicating the product, order number, delivery date. The Seller has the right to ask the Buyer to provide other information necessary to ensure the proper implementation of the Buyer's rights, including, ask to fill in special application forms. Upon receipt of the request to return the product, the Seller will provide the Buyer with a notice of receipt of the request. 12.8. Upon a reasoned request for the return of the product, the Buyer must return the non-perishable product no later than within 15 calendar days, perishable product – within 72 hours, unless the Seller specifies a longer term. The Buyer coordinates the specific time and place of transfer of the product with a Representative of LastMile, who, upon return request, contacts the Buyer with the contacts specified by him. 12.9. The costs of returning quality products, which in any case are not lower than their delivery price, shall be borne by the Buyer. The cost of returning defective products shall be borne by the Seller. 12.10. The price paid for the products duly accepted by the Buyer but subsequently returned, as well as the costs of delivery of the product, if they are refunded following clause 12.9 of the Rules, shall be refunded to the Buyer within 14 working days by transferring this amount of money to the bank account from which the payment was made when placing the order.

13. Personal data

13.1. The Buyer's personal data will be processed following the Privacy Policy. If the Buyer uses the services of LastMile store, it is considered that he/she agrees with the processing of the Buyer's personal data and confirms that all information and personal data provided are correct and correspond to reality. 13.2. The Buyer's personal data will be used to identify the Buyer, determine whether the Buyer and the person to whom the products are delivered meet the age requirements established by the legal acts of the Republic of Lithuania, carrying out sales and delivery, issuing accounting documents, returning overpayments and/or money for products returned by the Buyer, administering debts, fulfilling other obligations arising from the purchase and sale agreement provided for in the Rules and ensuring the Buyer's access to other services of LastMile store. 13.3. The Buyer's personal data will be processed for direct marketing purposes only with the Buyer's consent, which is provided when filling in the registration form and ticking the respective fields there.

14. Claims

14.1. Buyers are encouraged to make any claims regarding the implementation of these Rules, to resolve in good faith during friendly negotiations, to inform the Seller about their complaints by e-mail info@lastmile.lt. 14.2. If the Buyer and the Seller fail to reach an amicable settlement within 14 days from the receipt of the Buyer's claim, the Consumer has the right to apply to the entity dealing with out-of-court consumer disputes, i.e. State Consumer Rights Protection Authority (Vilniaus St. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, tel. 852626751, website www.vvtat.lt), to its territorial subdivisions or fill in the application form remotely, at the address http://ec.europa.eu/consumers/odr/ on the ODR platform.
